Terms of Service (TOS) - Mortis Development
Introduction
Welcome to Mortis Development! These Terms of Service ("TOS") govern your use of our services offered by Mortis Development. By engaging our services, you agree to comply with these terms. Please read them carefully.
Service Orders and Payment
2.1 Service Orders: Clients may request services by submitting a detailed service order form through our designated platform or by contacting Mortis Development directly. The service order should specify the scope, requirements, and any other relevant details of the requested service.
2.2 Payment Terms: Clients are required to make payment in advance before the service order is initiated. Alternatively, clients may choose to pay 50% of the total service fee upfront, with the remaining 50% due upon completion of the service. Service orders will only be processed once payment is received.
Service Delivery
3.1 Work Completion: Mortis Development will make reasonable efforts to complete all service orders within the estimated delivery time communicated to the client upon order confirmation. Any delays or changes to the delivery schedule will be promptly communicated to the client.
3.2 Product Delivery: Products or services developed or provided by Mortis Development will be delivered to the client upon full payment of the service fee. Delivery methods may include electronic delivery, direct download, or other mutually agreed-upon methods. Clients are responsible for ensuring the compatibility and functionality of the delivered products or services.
Client Responsibilities
4.1 Accurate Information: Clients must provide accurate and detailed information when creating service orders to ensure the successful delivery of services. Any changes or updates to the requirements should be promptly communicated to Mortis Development.
4.2 Feedback and Communication: Clients are encouraged to provide feedback and communicate openly with Mortis Development throughout the service process. Timely responses to inquiries and requests will facilitate efficient service delivery. Mortis Development will designate a primary contact person for each service order to streamline communication.
Refunds and Cancellations
5.1 Refund Policy: Service fees are non-refundable once the service order has been initiated. However, Mortis Development may consider refunds or credits in exceptional circumstances, such as project cancellation due to unforeseen circumstances or failure to deliver services as agreed upon.
5.2 Cancellation: Clients may request to cancel a service order at any time. Cancellations made after the service has commenced may be subject to cancellation fees, determined on a case-by-case basis. Mortis Development reserves the right to cancel a service order if the client fails to comply with the terms of the agreement or engages in behavior that violates applicable laws or regulations.
Intellectual Property
6.1 Ownership: Products or services developed or provided by Mortis Development, including but not limited to custom Minecraft plugins, server configurations, and other software solutions, are the intellectual property of Mortis Development unless otherwise agreed upon in writing.
6.2 License: Upon full payment of the service fee, clients are granted a non-exclusive, non-transferable license to use the products or services provided by Mortis Development for their intended purpose. Clients may not modify, distribute, or sublicense the products or services without prior written consent from Mortis Development.
Limitation of Liability
Mortis Development shall not be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in any way connected with the use of our services. This includes but is not limited to loss of data, loss of profits, or interruption of business operations.
Governing Law
These Terms of Service shall be governed by and construed in accordance with the laws of Pakistan, without regard to its conflict of law provisions. Any disputes arising from or related to these terms shall be subject to the exclusive jurisdiction of the courts of Pakistan.
Changes to Terms
Mortis Development reserves the right to modify or revise these Terms of Service at any time. Clients will be notified of any changes, and continued use of our services constitutes acceptance of the updated terms.
